Welcome to Emeralds Furniture (emeraldsfurniture.com). These Terms of Use govern your access to and use of our website, services, and the purchase of our furniture, including bespoke and custom-manufactured items. By accessing or using our website, you agree to be bound by these Terms.

“User,” “You,” “Client” refers to any individual or entity accessing or using the website or placing an order.

“Product” refers to any furniture item purchased, whether from the standard catalog or as a Bespoke Order.

“Bespoke Order” refers to any furniture commissioned or manufactured according to custom specifications, designs, or materials provided or chosen by the Client.
2. Use of the Website
You agree to use the website only for lawful purposes and in a way that does not infringe upon the rights of others or restrict the use and enjoyment of the website by any third party.

Intellectual Property: All content on the website, including designs, text, graphics, logos, and images, is the property of Emeralds Furniture and is protected by copyright laws. You may not reproduce, distribute, or exploit any content without our express written permission.
3. Product Accuracy and Materials
While we strive for accuracy, the nature of bespoke furniture involves natural materials and unique crafting:

Natural Materials: Wood, leather, and fabric are natural materials. Variations in grain, color, texture, and finish are inherent characteristics and are not considered defects. The final Product may vary slightly from website images or showroom samples.

Measurements: All measurements provided on the website or in initial quotes are approximate. Final dimensions of Bespoke Orders are subject to minor variations necessary for manufacturing integrity.

Pricing: Prices are subject to change without prior notice. The price for a specific order is confirmed only upon the issuance of a formal quotation and the receipt of a down payment.
4. Bespoke Order Policy (Custom Commissions)
This section governs the unique relationship established for custom furniture manufacturing:
4.1. Design Specifications
The Client is responsible for providing final and accurate specifications (dimensions, materials, and features) for all Bespoke Orders. Once the final design is approved by the Client, any subsequent changes may incur additional fees and extend the delivery timeline.
4.2. Down Payment and Commencement
A non-refundable down payment (typically 50% of the total cost) is required to initiate the manufacturing of any Bespoke Order. Production will only commence upon clearance of this payment.
4.3. Design Changes and Cancellation

Changes: Any request for design changes after manufacturing has commenced must be submitted in writing and may be subject to acceptance, additional charges, and a new delivery estimate.

Cancellation: Down payments for Bespoke Orders are non-refundable. If the Client cancels a Bespoke Order after production has begun, the down payment will be forfeited to cover materials and labor already expended.
4.4. Final Payment
The remaining balance (50% or as stated in the contract) is due in full upon completion of the Product and prior to scheduling delivery or collection. We reserve the right to hold the Product until full payment is received.
5. Delivery, Installation, and Acceptance

Delivery Estimates: All delivery timelines provided are estimates. While we strive to meet them, delays due to material sourcing, shipping, or unforeseen manufacturing issues may occur. We will notify the Client of any significant changes.

Acceptance: The Client (or their designated representative) must inspect the Product upon delivery. Any damage must be noted immediately on the delivery receipt. Failure to note visible damage at the time of delivery may waive the Company’s liability for that damage.
6. Limitation of Liability and Warranty

Warranty: Products are warranted against manufacturing defects for a period specified in the official sales contract. This warranty does not cover normal wear and tear, misuse, accidental damage, or modifications made by the Client.

Liability: Emeralds Furniture shall not be liable for any indirect, consequential, or incidental damages arising from the use or inability to use the Product or our services. Our liability is strictly limited to the cost of the Product purchased.
7. Governing Law
